New Zealand Consumer Law Requirements

Our goods and services come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 (‘New Zealand Consumer Law’). You are entitled to a replacement or refund for goods that fail to meet minimum statutory guarantees set out in the Consumer Guarantees Act 1993, in accordance with that Act.

In addition to the rights conferred by New Zealand Consumer Law, the express warranties and policies set out in these General Terms And Conditions Of Purchase apply.

These terms apply to all users of the domains layazjewellery.com The terms and conditions will be valid for all your future transactions with Layaz Jewellers Limited (henceforth: Layaz Jewellers Limited; may be referred to as 'us' or 'we' or “Layaz”) and visits to the website. Layaz reserves the right of these terms and conditions.

Delivery

We are committed to ensuring your order arrives safely and securely at your doorstep,
regardless of your international location. This policy outlines the shipping options, timelines, and potential risks associated with your online purchase.

Delivery Rates:

  • Free Shipping : We offer free standard delivery on all orders.

Order Processing Time:

Please note that all orders require a processing time of 4 Weeks before it is dispatched. This allows us to carefully design, engineer and package your special piece.

Delivery Time:

We currently offer two delivery options based on the location:

  • New Zealand: It typically takes 3-5 business days for delivery after your order is processed.
  • Austrailia: It typically takes 7-10 business days for delivery after your order is processed.

Please note that delivery times are estimates and may vary due to unforeseen circumstances.

Lost or Damaged Packages: We take great care to ensure your jewellery is securely packaged before shipment. However, if your package is lost or damaged in transit, please contact us immediately at orders@layazjewellery.com with your order number and a brief description of the issue. We will work with the carrier to resolve the problem as quickly as possible.


Lifetime Warranty

We at Layaz understand that sometimes even the best of us makes mistakes. To ensure we have you covered when the final product does not retain its quality as promised we introduced the lifetime warranty policy. This policy does not apply to items that have been damaged due to misuse, abuse, neglect, or alteration.


Eligibility for Lifetime Warranty:

  • Lifetime Repair or Replacement: Layaz warrants that all products will be repaired or replaced, at our discretion, for any defects in materials or workmanship.
  • No Charge: All repairs or replacements will be made at no charge to the original purchaser.

Non Eligible for Warranty:

The warranty does not cover the following:

  • Damage caused by accidents, misuse, abuse, neglect, or alteration.
  • Loss or theft of the jewellery.
  • Damage resulting from exposure to harsh chemicals, extreme temperatures, or other environmental factors.
  • Damage caused by normal wear and tear, such as scratches, dents, or discoloration.
  • Gemstones and diamonds are not guaranteed against chips and wear and tear.


Disclaimer:

If there is evidence that there has been any additional work done on the jewellery product by a third party after purchase, our lifetime guarantee is void.

 

Warranty Claim Process:

To initiate a claim, please contact us by email at orders@layazjewellery.com
or phone us at +6422 344 6808.

We will provide you with a Warranty Claim Authorization (WCA) number and instructions on how to deliver your item securely. 

All warranties are subject to inspection and assessment by our sales team or manufacturing facility team. If our sales team is not able to carry out a proper assessment, your item may be sent to our manufacturing facility for proper assessment. Repair or refunds will be made only subject to any applicable Consumer Law and Layaz Jewellery Limited’s General Terms and Conditions of Purchase.

Any refund or replacement (if and as applicable) will be made to you within a reasonable amount of time. We refund you the same way that you initially paid for your purchase except refunds of cash payments may be made by cheque, direct credit or to a debit card in the name of the purchaser. Refunds will only be made to the debit/credit card or finance account used for the original purchase, so please be aware of this if you intend to return an item given to you as a gift.

Additional Information:

We reserve the right to limit warranty claims for a reasonable time in cases of excessive claim activity. This return policy applies to purchases made online or in person.



Buyer Return Protection

Change of Mind Returns:

Our change of mind returns policy is only applicable products that are ready made and have not undergon any form of customization as requested by the customer, it is not applicable for made to order products, unless otherwise specifically stated by a representative of Layaz Jewellers Limited in writing during the time of purchase.

Eligibility for Return or Exchange:

  • If the item is faulty, in accordance with your rights under the New Zealand Consumer Law. Depending on the fault we may either repair the item, replace it, or provide a refund
  • You may return or exchange most unworn, undamaged, and unaltered merchandise within 30 days of the original purchase date.
  • Proof of purchase (receipt or invoice) is required for all returns and exchanges.
  • Gift recipients may exchange their merchandise for an item of equal or greater value. A gift receipt is required.


Items Not Eligible for Return or Exchange:

  • Items that have been worn, damaged, engraved, resized, or otherwise altered.
  • Change of mind returns on items that have undergone any particular customization as requested by the customer.

Condition of Returned Merchandise:

  • Merchandise must be returned in its original, undamaged packaging, with all tags attached.
  • Any item showing signs of wear or damage will not be accepted for return or exchange.

We will provide you with a Return Merchandise Authorization (RMA) number and instructions on how to return your item securely.

You are responsible for all shipping costs associated with returning your item (does not apply for orders that does not meet agreed specifications). We recommend using a trackable and insured shipping service.

 

Refunds and Exchanges:

All returns are subject to inspection and assessment by our sales team or manufacturing facility team. If our sales team is not able to carry out a proper assessment, your item may be sent to our manufacturing facility for proper assessment. Money Back Guarantee

What This Policy Covers:

This policy applies to situations where the actual product you receive does not meet the agreed-upon product requirements. This includes, but is not limited to:

  • Material discrepancies: The jewellery is made from a different material than what was advertised or agreed upon during a custom order.
  • Stones: The gemstones are not of the specified size, quality, or clarity.
  • Design discrepancies: The design of the jewellery significantly differs from the advertised image or agreed upon custom design.
  • Manufacturing defects: The jewellery has visible flaws in craftsmanship or construction.


What This Policy Does Not Cover:

  • Change of mind: This policy does not apply if you simply change your mind or no longer desire the product.
  • Normal wear and tear: Damage caused by everyday use is not covered under this policy.
  • Improper care: Damage resulting from improper cleaning, storage, or use is not covered.
  • Minor variations: For custom-made pieces minor variations from the design mock up may occur due to the manufacturing nature. However, significant deviations will be addressed under this policy.

How to Make a Return:

To request a refund under this policy, please follow these steps:

  2. Provide your original receipt or proof of purchase.
  3. Explain the reason for your return and how the product does not meet the agreed-upon requirements.
  4. Upon verification, we will gladly offer you a full refund for the purchase price of the jewellery, excluding any shipping costs.



Jewellery Authenticity Report

At Layaz, we are committed to providing our customers with authentic jewellery at the
highest quality. We understand the importance of trust and transparency, and that's why we offer Jewellery Authenticity Reports for all our products free of charge.

What is a Jewellery Authenticity Report?

A Jewellery Authenticity Report is a document issued by a qualified gemmological laboratory that verifies the following details about your jewellery:

Metal Content: The report confirms the type and purity of the metal used
(e.g., 18k yellow gold, platinum, 14K white gold etc..)

Gemstone Authenticity: It identifies and describes the gemstones used
(e.g., natural diamond, lab grown diamond, natural sapphire, synthetic sapphire, etc..)

Gemstone Quality: Depending on the chosen report level, it may detail characteristics like cut, clarity, colour, and carat weight.

Authenticity Report serves as:

  • A unique identification number for your specific piece.
  • A brief description of the jewellery, including metal type, gemstone details, and any unique design features.
  • (Optional, depending on level) Grading reports with cut, clarity, colour, and carat weight for gemstones.

At Layaz, we stand by the quality and authenticity of our jewellery. The jewellery authenticity report program is a testament to our dedication to providing our customers with exceptional value and a truly trustworthy shopping experience.

Considerations for This Report

  • This report is intended to assist the buyer in identifying the contents of the jewellery piece, facilitating activities such as independent insurance valuations.
  • This report is based on the findings of Precious Gem Testing Laboratories (Pvt) Ltd Sri Lanka, an assessment of heat treatment enhancements is outside the scope of this report.
  • To ensure the most precise analysis, each gemstone has been assessed out of its setting. Please note that assessment within setting itself may influence the perceived colour, clarity or brilliance of the stones.
  • The findings of this report are solely valid as of the date of sale (Report Date). LAYAZ Jewellers Limited assumes no responsibility for any alterations made to the product subsequent to its purchase.


Natural Gemstones

The term "AAA" can be used differently by each jeweller.

It's important to ask your jeweller exactly what they consider to be AAA quality.

AAA Quality at LAYAZ:

  • A vibrant, rich colour
  • No visible inclusions to the naked eye
  • An excellent cut that maximizes its brilliance
  • Not undergone artificial treatment to camouflage cracks and inclusions.

Layaz sources its gemstones from Sri Lanka, famously dubbed as the "island of gems" it is a participant country of the United Nations Kimberly Process.

Transparency: We are committed to transparency in our gemstone sourcing. We will clearly identify all our natural gemstones by providing authenticity certifications.

Ethical Sourcing: We strive to source our natural gemstones from reputable suppliers who adhere to ethical and sustainable practices only.

Education: We believe in educating our customers with the information they need to make informed choices about natural gemstones and its sourcing practices.

Alternative Choices: We believe our customers should be given a choice of alternative precious natural gemstones. We are proud to give our customers a choice of over 20 different natural gemstones including Sapphires, Rubies and Emeralds as alternatives to diamonds.

In an instance where Layaz uses Lab Grown or synthetic gemstones we are committed to clearly indicate this to our customers in both our product descriptions and product details to ensure customers make an informed choice.
